Qualifying offences

For the purposes of this Part, a qualifying offence is an offence —
listed in subsection (2); and
where, in relation to the offence mentioned in subsection (2)(a), (b) or (c), the injury or death was caused by a firearm or other offensive weapon; or
where, in relation to the offence mentioned in subsection (2)(d), (e) or (f), the commission of the offence involved a firearm or other offensive weapon.
The offences referred to in subsection (1) are —
murder;
attempted murder;
manslaughter;
robbery;
attempted robbery;
rape.
The Cabinet may, by order, amend subsection (2).

qualifying offence
