Fees in respect of vessels or structures taken into custody or stored by the Coast Guard

13. (1) Where a vessel or structure is —
taken into custody under this Act; or
being stored by the Coast Guard pursuant to any lawful authority, the owner or person last having control of the vessel or structure, unless otherwise determined by the court, shall pay to the Commandant the fees referred to in subsection (2), which are set out in Schedule 4.
The fees under subsection (1) are —
towing fees in respect of every hour or part of an hour where the vessel is towed by the Coast Guard; and
storage fees in respect of every day or part of a day that the vessel or structure remains in the custody of, or stored by, the Coast Guard.
An officer is not liable for any loss or damage to any vessel or structure referred to in subsection (1), or any loss or injury to any person or property on board any such vessel or structure, unless it is shown that the officer acted negligently or in bad faith.
